General Terms and Conditions

IMPORTANT NOTICE:
These Terms & Conditions (“T&Cs”) form a legally binding agreement between ACTIVE COMPUTERS UK LIMITED (“Company,” “we,” “us”) and you, the customer (“Client,” “you”), for the supply of goods and services. By placing an order, confirming a booking, or accepting a quotation, you agree to these T&Cs.
STATUTORY RIGHTS:
These T&Cs are in addition to your statutory rights under the Consumer Rights Act 2015 (CRA 2015) and do not affect them. Your statutory rights include the right to goods that are of satisfactory quality, fit for purpose, and services carried out with reasonable care and skill.

Service Hours and Attendance
Standard Hours: Monday to Friday, 09:00 – 17:30
On-Site Visits: A responsible adult must be present during the entire visit
Out-of-Hours Support: Available for business clients at the specified rate
Service Engagement and Termination
We will use reasonable skill and care to diagnose and remedy reported faults.
You may cancel or terminate a service appointment at any time; charges incurred up to that point remain payable.
“No Fix, No Fee”
We do not offer a “No Fix, No Fee” arrangement. Charges apply where:
A solution is proposed but you choose not to proceed
Necessary items (software discs, serial numbers) are not provided
The fault is caused by a third party (e.g., your Internet Service Provider)
Labour Warranty
Services include a 1-month labour-only warranty from the invoice date against faulty workmanship.
Repeat faults caused by our workmanship within this period are repaired at no additional labour cost; parts are charged separately.
Warranty does not cover software faults, viruses, or user errors.

Contract Formation, Title, and Risk
A binding contract for Goods forms only when we accept your order; quotations are not binding offers.
Title remains with the Company until full payment is received.
Risk passes to you upon delivery.

Warranty Exclusions
Warranty does not cover:Lack of adequate servicing or maintenance
Fair wear and tear or cosmetic damage
Damage from external events (power surges, natural disasters)
Incompatibility with existing systems or software
Damage or alteration by you or unauthorised third parties

Pricing and Additional Charges
Fees may be adjusted for changes in work scope or non-disclosure of relevant information.
On-site costs, including parking and mileage (£1.50 per mile), are added to invoices.
Payment Terms
Payment is due immediately on delivery/completion.
Commercial invoices are payable within 30 days.
Late payments incur statutory interest (8% above Barclays Bank Base Rate) plus a surcharge (£20 or 8% of the outstanding amount, whichever is greater).
Disputed Invoices
Notify us of disputes within 48 hours of receipt.
Pay undisputed amounts within standard payment terms.
Cancellations
Must be notified at least 3 business hours before a scheduled appointment.
Late cancellations may incur full service charges.

Client Data Responsibility
You are responsible for backing up your data prior to service.
The Company is not liable for data loss, corruption, deletion, or alteration.
Limitation of Liability
We are not liable for faults beyond our control (e.g., equipment age, third-party issues).
Liability for indirect or consequential losses (lost profits, lost data) is excluded.
Nothing limits liability for death, personal injury, fraud, or statutory rights under CRA 2015.
You agree to indemnify the Company against losses arising from your use of our Services.
Non-Warranty Service Charges
A “No Fault Found” fee may apply where no manufacturing defect is identified.
We are not liable for damage caused by viruses or malware if reasonable care was taken.

Confidentiality and Right of Refusal
Your files and data will be treated confidentially.
We may refuse service for unlicensed/illegal software or obscene material.
Sub-Contracting, Complaints, and Governing Law
We may subcontract work unless otherwise agreed.

Force Majeure: not liable for events beyond our control (strikes, power failures).
Governing Law: English law; courts of England & Wales have exclusive jurisdiction.
Changes to Terms
We reserve the right to update these T&Cs at any time without prior notice.
PART G: Liquid Damage Device Repair Disclaimer
PART G – Liquid Damage Device Disclaimer
Repairs for liquid-damaged devices may be complex and unpredictable.
No warranty is provided for liquid damage repairs.
Inspection Fee: £60, payable upon drop-off; deducted from final bill if repair is successful.
Devices may continue to function despite corrosion; repairs may cause additional faults or be terminal.
The Company is not liable for data loss or device failure during or after repair.
