Build My Website Terms & Conditions

1. Definitions

Agreement – The Order Confirmation, these Terms, and the General Terms collectively.
Business Hours – 9:00–17:00, Monday–Friday (excluding public holidays).
Company – Active Computers UK Limited.
Term – Duration of the Services, including Initial Term and any renewal period.
General Terms – Company’s general terms and conditions as listed on its website.
Initial Term – Minimum of 12 months from the Order Confirmation or any other period stated.
Major Changes – Changes including site layout, design, header/footer redesign, custom scripting, or work exceeding 2 hours.
Minor Changes – Small edits, e.g., text changes, font adjustments, color changes, or minor additions.
Material – Images, text, graphics, or trademarks.
Package – Client’s purchased website package (5, 10, or 15 pages).
Services – Build My Website services provided by the Company (link).
Terms – These terms and conditions.

2. Scope of the Agreement

These Terms supplement the General Terms and Hosted Service Terms. In case of conflict, these Terms prevail.
Applicable to all Clients worldwide using the Services.
Covers Connect Website services and related maintenance under the selected Package.
Company manages and controls the website throughout the Term.

3. Service Delivery

Company will provide Services with reasonable care and skill but does not guarantee uninterrupted or error-free operation.
Communications may be recorded for business and monitoring purposes.
Client must be over 18 to register.
Websites are based on Company templates specific to the purchased Package.
Clients may request up to 3 Minor Changes per page prior to publishing. Major Changes or additional edits may incur extra fees.
All requests must be submitted in writing via email.
Company maintains full control over the website during the Term. Client’s access is limited for security purposes.
Product limits and image allowances apply for store set-up services.
Client warrants that any Materials supplied are original or properly licensed. Client indemnifies the Company against IP infringement claims.
Additional work beyond contracted services is charged at £70 + VAT per hour.
Full website control can be requested in writing, but service fees continue until the Term ends.

4. Proofreading

Professional proofreading is included for minor edits.
Substantial editing requires additional fees.
“Unlimited” proofreading is capped at 400 words per page.

5. Updates

Maximum of 3 batches of updates per month (6 hours total).
Changes outside the template or exceeding 6 hours are chargeable.
Image updates limited to 9 stock images per month.
Copywriting updates included per Package; additional words incur fees.

6. Upgrades

Package upgrades are permitted with additional fees.
Downgrades are not permitted.
Extra pages or products incur additional charges.
Copywriting beyond Package limits costs £50 + VAT per 200 words.
Additional store products cost £40 per 10 items.

7. Domain Registration

Domain registration must match the account holder.
Client must renew domains before expiry.
Non-renewal allows a 5-day grace period before suspension.
Domains may be transferred with 5 days’ written notice, but failure may suspend Services.
Domain registration follows Company domain terms.

8. Fees and Payments

Fees are as per the Order Confirmation and Company website; may vary.
Monthly or yearly billing options available. Upgrades permitted; downgrades are not.
Set-up fees are due upon purchase.
Fees must be paid within 7 days of invoice.
After Initial Term, Services continue on a monthly rolling basis.

9. Term and Termination

Services are subject to a minimum Initial Term.
Cancellation requires 30 days’ written notice.
Early termination within Initial Term requires payment of remaining balance.
Automatic renewal occurs monthly after Initial Term unless notice is provided.
Company may suspend Services for non-payment, domain issues, insolvency, or other legitimate reasons.

10. Support

Telephone support is available during Business Hours.

11. Intellectual Property

Legal ownership of the website is with the Client; Company retains control during the Term.
Company images and content are licensed for website use only. Termination prevents further use.
Client-supplied content belongs to the Client.

12. Web Hosting

Hosting included, with limits depending on Package:

5 Pages: Disk Usage: 1000 MB; Bandwidth: 3000 MB

10 Pages: Disk Usage: 1500 MB; Bandwidth: 5000 MB

15 Pages: Disk Usage: 2000 MB; Bandwidth: 7500 MB

Exceeding limits incurs additional charges:

Disk: £3 per 100 MB

Bandwidth: £2.50 per 100 MB

Upgrades available:

1 GB Disk: £10/month

1 GB Bandwidth: £7/month

1 Email Account (250 MB): £3.99/month

13. Liability

Company may remove websites for illegal activity.
Not liable for delays or errors beyond control (acts of God, government, strikes, system faults, etc.).
ETA for work is provided but not guaranteed.
Agreement governed by laws of England and Wales. Jurisdiction: English courts.
Company not liable for content breaching foreign laws.
